Representation Agreements

Representation Agreements have replaced Living Wills. They allow you to appoint a caregiver to make health decisions for you if you are unable to or need assistance. There are two types.

Section 7 Representation Agreement

Covers routine financial day to day activities, and minor health care decisions.

Does not cover issues with Real estate.

A person is not required to prove capacity to enter into a Contract.

Section 9 Representation Agreement

Covers major heath care decisions.

Use with a Power of Attorney for major financial issues and real estate transactions.

A person must have capacity to enter into a contract.
